Donations to Federal Campaign

Donor Obligations & Eligibilty
Amounts received by the Libertarian Party of more than $16,900 in the 2024-25 financial year will be subject to disclosure under the provisions of the Commonwealth Electoral Act 1918.

The Commonwealth Electoral Act 1918 prohibits the knowing receipt of donations from foreign donors. Foreign donors include:
  • a foreign public enterprise;
  • an entity (whether or not incorporated) that does not meet any of the following conditions:
    • the entity is incorporated in Australia;
    • the entity's head office is in Australia;
    • the entity's principal place of activity is, or is in, Australia;
  • an individual who is none of the following:
    • an elector;
    • an Australian citizen;
    • an Australian resident;
    • a New Zealand citizen who holds a Subclass 444 (Special Category) visa under the Migration Act 1958 (or if that Subclass ceases to exist, the kind of visa that replaces that Subclass).

Donations to State Campaign

Donor Eligibility: Donations to the Libertarian Party NSW can only be made by:

  • people on the electoral roll.
  • entities with a business number.
  • those whose identification has been accepted by the NSW Electoral Commission.

This includes direct monetary contributions, event attendance fees, and annual or other party subscriptions. For more information on who can make a political donation, click here.

Prohibited Donors: It is unlawful for prohibited donors to make political donations in NSW. A prohibited donor is:

  • a property developer.
  • a tobacco industry business entity.
  • a liquor or gambling industry business entity, including a registered club if the business undertaken by the registered club includes wagering, betting or other gambling.
  • any industry representative organisation if the majority of its members are such prohibited donors.
  • a close associate of a prohibited donor.

If a person makes a political donation and within 12 months the person becomes a property developer, double the amount or value of the political donation must be paid by that person to the NSW Electoral Commission.For more information on prohibited donors, click here.

Disclosure Requirements: The NSW Electoral Commission requires a political donor to disclose a donation made to the Libertarian Party NSW that is valued at $1,000 or more. This includes multiple donations made by the same donor that in aggregate are valued at $1,000 or more in one financial year. Penalties apply for failure to lodge a disclosure where required. Donation Cap: Political donations in NSW are capped at $7,900 for the 2024-2025 financial year. A donation made after 30 June 2025 is considered a donation for the 2025-2026 financial year. For more information on donations that are exempt from the cap, click here.
